Senior Counsel, Litigation

An experienced legal practitioner, the Senior Counsel, Litigation provides comprehensive, high-quality, timely, and practical advice to internal clients throughout the Westinghouse global enterprise regarding litigation, commercial claims, and related matters.  This role works closely with internal clients at all management levels and in-house colleagues in accomplishing this objective.  Actively manages and oversees outside counsel when necessary.  Also assists in advising the Energy Systems business unit on commercial matters in North America.

Your Day to Day:

• Provide prompt, practical, and risk-informed advice and counsel to internal clients on litigation, claims, and other commercial legal issues affecting Westinghouse.  This role will represent the company in commercial negotiations and disputes, interfacing and negotiating with government agencies and opposing counsel.
• Consistent with the Westinghouse Global Ethics Code and governance policies, facilitate the company’s business objectives while maintaining legal compliance.  Engage with legal and compliance specialists to mitigate legal risks to the company in the areas of ethics, antibribery, antitrust, trade compliance and export controls, sanctions, data privacy, regulatory, labor & employment, environment, health and safety matters, and in any type of government enforcement process.
• Partners with business clients to achieve the best possible results for Westinghouse, consistent with legal requirements and business objectives.  Effectively interface with a wide range of internal clients and colleagues, including business leaders, other in-house attorneys, contracts and commercial affairs professionals, supply chain, finance, tax, engineering, licensing, and compliance. 
• Work closely with and manage outside counsel in the United States and worldwide to ensure effective and efficient representation of Westinghouse in disputes and other matters.
• When necessary, advises on internal investigations, government investigations, and related legal compliance matters, including interface with government officials and attorneys.
• Provide legal support to the Energy Systems (new plants) business unit.  This includes drafting, reviewing, and negotiating commercial contracts, teaming agreements, and related documents, advising on the response to proposals, and related legal advice, primarily in North America.
• Remain current on legal developments within scope of responsibilities and provide updates to clients as warranted.  Develop and implement policies and programs and conduct training on legal issues as necessary for the business.
• Provide legal advice on other matters as may arise in the course of business.

Who You Are:

•   J.D. from an accredited law school.
• Minimum 5 years of experience representing clients in commercial litigation matters, either in-house at an international company, in a law firm, or both.  Successful candidate will have experience in providing legal advice on the full scope of commercial business issues. 
• Admitted to practice in a US jurisdiction is required.  If not currently admitted in Pennsylvania, a successful candidate would need to have the ability to be licensed in Pennsylvania.
• Experience providing exceptional service to corporate clients, with demonstrated ability to develop strategic relationships across the organization and experience addressing emerging challenges in a practical, risk-informed manner.
• Experience in general commercial law and litigation is required, including advising clients on the sale of goods and services, the Unform Commercial Code, common law contracts and torts, and litigation practice and procedure.  Extensive knowledge in engineering, procurement, and construction claims is highly desired.  A working knowledge of related areas of the law, including international disputes, intellectual property law, litigation practice, and government investigations will also be necessary.
• Experience drafting and reviewing high-quality legal documents, including litigation pleadings, motions, and related documents, letters and other external correspondence, memoranda, company policies, training materials, and presentations for management.
• Highly developed analytical and communication skills, both verbal and written.
• Expert negotiation skills and experience resolving disputes.
