Contract Manager - EMEA

This position may reside in Germany, Spain or Sweden. 

 

Your Day to Day

  • The CMD&D is responsible for preparation of the project commercial execution plan for assigned projects/contracts in accordance with Westinghouse Contract Management policy requirements
  • Identification of relevant contract obligations and related commercial risks with customer, consortium partners, subcontractors, suppliers and other third-parties
  • Development and implementation of project specific contractual procedures, particularly regarding contract commercial correspondence and notifications, variation/change orders, claims, and insurance,
  • Coordinate review and acceptance of plan procedures with Legal to ensure preservation of our contract claim rights and entitlements under relevant contract laws. 
  • Coordinate review and acceptance of plan procedures with Global Supply Chain Solutions to provide for appropriate active monitoring and coordination of all subcontractors’ and suppliers’ contract risks, change and claims management, and regular updates to the project risk register
  • Assume responsibility for implementation of all project commercial activities from order turnover phase (from sales team to project execution team) until all relevant commercial obligations are complete and all relevant commercial issues are resolved / settled.
  • Ensure proper notices and responses are communicated consistent with contractual requirements.
  • Management of changes and claims to / from customers and (when applicable) consortium partners.
  • Support the management of claims to / from subcontractors and suppliers as required.
  • Control back-charges from customer and manage appropriate recovery plans from third parties (consortium partners, subcontractors, suppliers).
  • Coordination with Legal / Commercial Affairs group on claims in accordance with company CM / LOA policy requirements.
  • Development and implementation of appropriate commercial risk mitigation action plans.
  • Management of project insurance obligations, including coordination with Legal for submittal of insurance notices and claims, and monitoring and settlement of insurance claims in accordance with company policies.
  • Communicate with the Project Manager or their designee to ensure appropriate schedules are produced and maintained to support project commercial execution plan procedures, including active monitoring of contract liquidated damages risk and/or other contract schedule risks
  • Support project risk and opportunity identification and analysis and company reporting requirements.
  • Provide support and guidance to the project team on general contract issues. Coordination with Legal for clarification of contractual and legal queries.
  • For above actions, regular reporting to BU Management to allow the control and monitoring of commercial issues for the project.
  • Travel after COVID restrictions are lifted:
  • It is expected that periodic travel to Westinghouse offices or Project job sites will be required.

Who You Are:

As a successful candidate, you’d bring the following to the team:

BS/BA, with coursework in contract management, law, business administration, engineering, finance and/or project management. 

Contract Management certificates from an accredited university or industry group preferred

 

Knowledge / Experience

  • A minimum of five years’ contract management experience in a multicultural engineering or construction environment
  • Fluent in English

  • Strong commercial experience of contracts including contract and commercial correspondence drafting and the ability to identify and understand the salient points and issues.
  • The ability to assimilate contractual and legal issues quickly and have a solid track record of successful management of claims.
