As a Project Commercial Director for New Plants Projects Commercial Contracts department you will be responsible for contract management services for the Bulgaria Engineering Services Contract. As an individual contributor, you'll ensure that all contract management activities are performed in accordance with Project/ES Business Unit directives and instructions, including Company procedures.

You will report to the VP Commercial Contracts – Energy Systems.

 

As this is a hybrid role, we are open to candidates located in Bulgaria or willing to relocate.

 

Main Responsibilities:

 

  • Contract Execution (from Project Kick-off to project closure) and then lead of Contract Management activities under the subsequent EP+C Contract

  • Establish contract strategy and lead implementation of strategic contract opportunities.

  • Support Legal in handling formal dispute resolution (mediation, litigation and arbitration).  Notifies and liaises with Legal to report major claims and keeps Legal updated of any critical development during project execution.

  • Analyze prime contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds.  Seek advice from Legal to finalize amendment-change orders during the Project Execution phases.  Develops and implements risk mitigation and opportunity plan in collaboration with Project Director.

  • Ensure that contract insurance provisions are observed

  • Support Supply Chain and other departments in the development of Purchase Orders, Contracts and Subcontracts ensuring that relevant (sub) contracts contain the necessary flow-down of main contract terms. 

  • Seek advice from Legal (Export Control) to ensure accurate handling of all export control matters and ensures close review of all contracts and projects with regard to restrictions on exports, considering countries, customers or products involved and the respective laws and Westinghouse regulations.

  • Support the development process of the offer for the EP+C Contract in full coordination with the other departments, ensuring the offer meets all contract requirements.

  • Participate to the negotiations of the EPC Contract.  Lead the contract management activities during EP+C execution up to EP+C contract closure

  • Support drafting of Project Review documentation and executive management briefing materials for communication of updates/status of project execution, change order, claims negotiation and settlement. 

Qualifications:

  • University degree in Engineering, Construction Management or Cost Engineering, Quantity Surveying, Business Administration; Contract Management or Law. 

  • At least 10 years real experience as Lead Contract Manager for projects in Europe required with at least 15 years’ experience in the field of complex EPC (engineering, procurement and construction) industrial project in the field of nuclear, oil & gas, power, automation, or similar industries. 

  • Experience in contract negotiations, contract analyzing and drafting, change orders negotiations, risks and opportunities monitoring and claim management/drafting. 

  • Fluent in English.  Bulgaria skills orally and written are recommended. 

  • The ability to understand and balance Customer requirement and our interests and risk exposure and to obtain agreement from clients are necessary skills..

  • Ability to explain requirements in terms accessible to senior leadership and non-contract managers
