As a Commercial Manager for the AP1000 New Plants Projects you will be responsible for ongoing contract management services. As an individual contributor, you'll ensure that all contract management activities are performed in accordance with Project/Energy System Business Unit directives and instructions, including Company procedures. This Commercial Manager position will be supporting a Commercial Director in various aspects of project coordination and execution during the project lifecycle.
You will report to the Director Commercial Operations – Energy Systems.
Location: Warsaw
Main Responsibilities:
• Current Contract Execution (from Project Kick-off to project closure) and then execution of Contract Management activities under the subsequent development contracts (e.g. EP+C)
• Execution of contract strategy and implementation of strategic contract opportunities.
• Support Legal in handling formal dispute resolution (mediation, litigation and arbitration). Notifies and liaises with Legal to report major claims and keeps Legal updated of any critical development during project execution.
• Analyze prime contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds. Seek advice from Legal to finalize amendment-change orders during the Project Execution phases. Develops and implements risk mitigation and opportunity plan in collaboration with Commercial Director.
• Ensure that contract insurance provisions are observed
• Support Supply Chain and other departments in the development of Purchase Orders, Contracts and Subcontracts ensuring that relevant (sub) contracts contain the necessary flow-down of main contract terms.
• Support for Commercial Director in the negotiations of the EPC Contract. Execution of the contract management activities during EP+C execution up to EP+C contract closure
• Support drafting of Project Review documentation and executive management briefing materials for communication of updates/status of project execution, change order, claims negotiation and settlement.
• Execution of change order contract procedure, invoicing, analyze commercial data in cooperation with other teams e.g. project control team
• Collaborate with the technical and management teams of project management and external customer
• Commercial Process Improvement, identify gaps and opportunities to improve the process and implementation. Take proactive steps to identify opportunities for improvement and implement solutions
Qualifications:
• University degree in Engineering, Construction Management or Cost Engineering, Business Administration or Finance; Contract Management.
• At least 5-8 years real experience as Contract Manager for projects in Europe
• Experience in Power Industry EPC Project execution would be preferable (engineering, procurement and construction).
• Experience in contract negotiations, contract analyzing, change orders negotiations, risks and opportunities monitoring and claim management.
• Strong organizational skills and ability to set priorities, manage time and multi-task
• Fluent in English.
• The ability to understand and balance Customer requirement and our interests and risk exposure and to obtain agreement from clients are necessary skills.
• Ability to explain requirements in terms accessible to senior leadership and non-contract managers
